How Nardi Fresh Produce Pty Ltd collects, uses, stores and discloses personal information.
1. About this policy
Nardi Fresh Produce Pty Ltd (ABN 99 701 500 683, ACN 701 500 683) is an Australian proprietary company based in North Geelong, Victoria (VIC) 3215. In this policy, "we", "us" and "our" refer to Nardi Fresh Produce Pty Ltd.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act. This policy explains what personal information we collect, why we collect it, who we may give it to, and how you can access or correct it.
"Personal information" has the meaning given to it in the Privacy Act 1988 (Cth): information or an opinion about an identified individual, or an individual who is reasonably identifiable.
2. What personal information we collect
We only collect personal information that is reasonably necessary for our functions and activities as a wholesale fresh produce supplier. This typically includes:
- Contact details — your name, the business you represent, your role, email address, postal or delivery address and any phone number you choose to give us.
- Account and order information — the produce lines you order, order history, delivery instructions, delivery runs and standing order arrangements.
- Billing information — the details needed to invoice a trade account and record payment. We do not store full payment card numbers on this website.
- Correspondence — enquiries, pricing requests, substitution and credit discussions, and our replies.
- Website information — limited technical data generated when you visit this site, as described in section 6.
We do not seek to collect sensitive information as defined in the Privacy Act 1988 (Cth), and we ask that you do not send it to us. If you do provide sensitive information, we will handle it in accordance with APP 3 and APP 6.
3. How we collect personal information
Wherever it is reasonable and practicable to do so, we collect personal information directly from you — for example when you email us, complete the enquiry form on the contact page, open a trade account, or place and adjust an order.
We may also collect information from someone else authorised to act for your business, such as a head chef, purchasing officer or venue manager placing an order on your behalf. If we receive personal information about you that we did not solicit, we will deal with it in accordance with APP 4.
You may deal with us anonymously or under a pseudonym for general enquiries. However, we cannot open a trade account, quote pricing for your lines or deliver an order without knowing who you are and where the produce is going.
4. Why we use personal information
We use personal information for the primary purpose for which it was collected, which is to supply wholesale produce and run the associated account. In practice, that means:
- responding to enquiries and preparing pricing;
- setting up, operating and administering a trade account;
- picking, packing, scheduling and delivering orders;
- contacting you about substitutions, shortages, delivery changes or credits;
- invoicing, collecting payment and maintaining financial records;
- handling complaints, product quality issues and food safety enquiries; and
- meeting our obligations under Australian law, including taxation and food-related record-keeping requirements.
We may use your business contact details to send you seasonal availability notes or produce updates relevant to your account. You can ask us to stop at any time by replying to the message or emailing us at the address in section 10, and we will action the request.
5. When we disclose personal information
We do not sell personal information, and we do not disclose it for another organisation's marketing purposes. We may disclose personal information to:
- Service providers who help us operate — for example transport and delivery contractors, our email and website hosting providers, accounting and bookkeeping services, and IT support. These providers only receive what they need to perform their function for us.
- Suppliers and growers, where it is necessary to fulfil a specific order or resolve a quality issue with a line supplied to you.
- Professional advisers such as our accountants, auditors, insurers and lawyers.
- Government agencies, regulators, courts or law enforcement, where disclosure is required or authorised by Australian law.
- A purchaser, if the business or part of it is sold or transferred, subject to the buyer treating the information in accordance with this policy.
We do not currently have an intention to disclose personal information to overseas recipients. Some service providers we use, such as email and website hosting, may store data on servers located outside Australia. Where that occurs, we take reasonable steps under APP 8 to ensure the recipient handles the information consistently with the Australian Privacy Principles.
6. This website and cookies
This is a static website. It does not use advertising cookies, analytics cookies, tracking pixels, social media widgets or third-party scripts, and it does not build a profile of your browsing.
Our hosting provider automatically records standard technical information when a page is requested, which may include your IP address, browser type, the page requested and the date and time of the request. This is used for security, to keep the site available, and to diagnose faults. It is not used to identify individual visitors.
The contact form on this website does not send data to a server. It opens a message in your own email program, addressed to us. Whatever you type is sent only when you choose to send that email, and it is then handled as ordinary correspondence under this policy.
Links to any external website are provided for convenience only. We are not responsible for the privacy practices or content of sites we do not operate.
7. Security and how long we keep information
We take reasonable steps under APP 11 to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include restricting access to account records to staff who need it, using password protection on business systems, and requiring our service providers to maintain appropriate safeguards.
No method of transmission or storage is completely secure. Email in particular is not a secure channel, so please do not send us sensitive information by email.
We keep personal information only for as long as we need it for the purposes described in this policy, or for as long as we are required to keep it under Australian law. Business and financial records are generally retained for at least seven years to satisfy taxation and corporate record-keeping requirements. When information is no longer needed and we are not required to retain it, we take reasonable steps to destroy it or de-identify it.
If an eligible data breach occurs, we will assess and respond to it in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth), including notifying affected individuals and the Office of the Australian Information Commissioner where required.
8. Accessing and correcting your information
Under APP 12 and APP 13 you may:
- ask for access to the personal information we hold about you;
- ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading;
- ask us to stop sending you produce updates or other non-essential messages; and
- ask how we handle your personal information generally.
Send your request to the email address in section 10. We may need to verify your identity, or that you are authorised to act for the business account concerned, before we can respond. We aim to respond within 30 days. Access is normally provided free of charge, although a reasonable charge may apply where a request requires substantial work. If we refuse a request for access or correction, we will tell you why in writing and explain how to complain.
9. Complaints
If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact us first at the email address in section 10. Set out what happened and what you would like us to do. We will acknowledge your complaint, investigate it and respond in writing, normally within 30 days.
If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC), which oversees the Privacy Act 1988 (Cth). The OAIC can be contacted through its website at oaic.gov.au, by phone on 1300 363 992, or by writing to GPO Box 5218, Sydney NSW 2001.
